South Australia’s Key Fair Work Decisions of 2025: Empowering Workers and Shaping the Workplace

2025 has been a defining year for workplace relations in South Australia, with several landmark Fair Work and industrial rulings strengthening employee rights and clarifying employer obligations. From wage increases to gig worker protections, the state has seen meaningful progress across multiple sectors. 

 

A highlight of the year was the State Wage Case, which resulted in a 3.5% increase to the minimum standard of remuneration, bringing the weekly rate to $965.10. This decision, aligned with the Fair Work Commission’s national review, ensured that workers could keep pace with rising living costs, underscoring the state’s commitment to fair pay. 

 

In a landmark ruling for low-paid workers, over 5,000 McDonald’s employees in South Australia won the right to engage in collective bargaining. Enabled by the federal Supported Bargaining laws, the decision empowers these workers to negotiate improvements such as higher wages and predictable working hours, reinforcing the importance of equitable treatment in the fast-food sector. 

 

The year also saw a breakthrough for gig economy workers. Adelaide Uber driver Mohammad Shareef Hotak successfully challenged his deactivation, with the Fair Work Commission ordering compensation for lost income. The case set a critical precedent, affirming that digital platforms must act fairly and responsibly toward the workers who rely on them. 

 

Finally, the Smout v Return to Work Corporation of South Australia case clarified how Permanent Impairment Assessments should be conducted, reinforcing that a single, comprehensive assessment is required to determine entitlements for injured workers. This provides much-needed clarity and certainty for employees navigating the state’s compensation system. 

 

Taken together, these 2025 decisions highlight South Australia’s evolving industrial landscape.
